Beacon Pro Suite Terms of Service

1. Business Use and Eligibility

Beacon Pro Suite is intended primarily for businesses and their authorized employees, contractors, administrators, and agents. You must have legal capacity to enter into these Terms and must use the Service only for lawful business purposes.

2. Accounts and Access

Customer organizations are responsible for designating authorized users, assigning roles and permissions, keeping account information accurate, and promptly removing access when a user should no longer have it. Users must protect their credentials and may not share accounts in a manner that defeats security or accountability controls.

3. Customer Data

As between Beacon Pro Suite and the customer organization, the customer retains ownership of the business data, customer records, documents, content, and other information it submits to the Service ("Customer Data"). The customer grants Beacon Pro Suite the rights reasonably necessary to host, process, transmit, display, back up, and otherwise handle Customer Data to provide, secure, support, and improve the Service.

The customer is responsible for having the rights and permissions necessary to provide Customer Data to the Service and for its own compliance with laws governing customers, employees, communications, records, and industry-specific data.

4. Google Business Profile and Other Integrations

The Service may allow a customer to connect Google Business Profile, Google APIs, payment processors, email providers, calendar providers, communications services, distributors, and other third-party services. A connection is enabled only when an authorized user initiates or approves it.

Use of Google services is also subject to applicable Google terms and policies. Beacon Pro Suite's handling of information received from Google APIs is described in our Privacy Policy.

Third-party services are not controlled by Beacon Pro Suite. Their availability, terms, pricing, features, and performance may change independently of the Service.

5. Acceptable Use

You may not use the Service to:

• Violate applicable law, regulation, court order, or third-party rights.
• Access another company's tenant, records, credentials, or systems without authorization.
• Introduce malicious code, interfere with security controls, probe for vulnerabilities without permission, or disrupt the Service.
• Use automated methods to abuse rate limits, overload infrastructure, scrape data unlawfully, or circumvent access controls.
• Send unlawful, deceptive, abusive, or unauthorized communications.
• Misrepresent review content, impersonate another person or business, or use connected Google functionality in violation of Google policies.

6. Fees, Plans, and Billing

Paid plans, implementation fees, optional modules, usage charges, and other commercial terms are governed by the applicable order form, proposal, subscription selection, or written agreement. Unless otherwise stated in that agreement, fees are due according to the billing terms presented when the service is purchased.

7. Availability, Changes, and Support

We work to keep the Service available and reliable, but no online service can be guaranteed to operate without interruption. We may update, improve, replace, or discontinue features, provided that we will use reasonable efforts to avoid materially impairing paid core functionality without notice where practical.

8. Intellectual Property

Beacon Pro Suite and its software, interfaces, designs, documentation, trademarks, logos, and underlying technology are owned by Beacon Air & Heat, Inc. or its licensors and are protected by applicable intellectual property laws. Except for the limited right to use the Service under these Terms, no ownership rights are transferred to the customer.

9. Confidentiality

Each party may receive non-public information from the other. Each party will use reasonable care to protect such confidential information and will use it only as necessary to perform or receive the Service, except where disclosure is required by law or the information is independently public or lawfully obtained without restriction.

10. Suspension and Termination

We may suspend or restrict access when reasonably necessary to address nonpayment, security risk, unlawful use, material breach of these Terms, or risk to other customers or the platform. Customers may stop using the Service subject to any applicable subscription or order terms.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided on an "as available" basis. Beacon Pro Suite does not warrant that the Service will be uninterrupted, error-free, or suitable for every business requirement. Customers remain responsible for business decisions, regulatory compliance, and review of information generated or displayed by the Service.

12. Limitation of Liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Service. Any additional liability limits or negotiated remedies stated in an applicable order form or written agreement will control to the extent of a conflict.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.

14. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of the Service after an update takes effect constitutes acceptance of the revised Terms where permitted by law.
